A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in federal detention.

In her decision, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The court proceedings involve conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.
